This site is owned and operated by Ascended LLC, a Limited Company incorporated in Uzbekistan, with a registration number of 311 233 882, having its registered office at 1, Street Furkat, Shaykhantakhur Area, Tashkent, Uzbekistan ("PDFZeus", or "we").
The Company is the owner and publisher of the Website pdfzeus.com. The Website is hosted by Cloudways, a company incorporated under Malta law located at 1st Floor Sqaq Lourdes, St Julians STJ3334, Malta.

Purpose

PDFZeus provides its Members with a document converter service at www.pdfzeus.com, which companies and individuals can use at their own risk.
These T&Cs govern your access to and use of the Site and Services.
When you register on the Site, you will be asked to check a box confirming that you have read and accept the T&Cs, which will form a valid contract between you and PDFZeus.
For the purposes of these T&Cs, terms entirely in capital letters or with the first letter in capital letters, whether used in the singular or plural, have the following meaning:

Definitions

In this document,
“CGU”: means these General Conditions of Use.
“Company”: means the Company publishing and owning the Website.
“Site”: means the online electronic service published by the Company, accessible at the address pdfzeus.com, as well as all elements relating to it.
“Services”: means all services, products, content, features, technologies and functionalities that are accessible through the Site.
“Conversion”: means one of the functions for changing the format of one document into another offered by the Site.
“Member”: means any natural or legal person having an Account on the Site.
“Personal space”: means the personal space made available to Members where you have the possibility to convert your documents, store them and contact pdfzeus.com.
“Online Assistance”: means all assistance services made available to Members, such as operators whose mission is to assist Members with any request made by telephone, email or via the contact page of our Site.
“Membership”: means the monthly paid membership that Members have the option to subscribe to on the Site. The Member subscribes to the Services for an indefinite period from the validation by the Company. This membership is without obligation and cancellable at any time by the Member.
“Basic Membership”: means the forty-eight (48) days period during which the Member benefits from unlimited access to the Site Services without being charged the membership fee. This basic membership period systematically takes place within the framework of a basic membership.

Opening An Account And Member Consent

Conditions

It is imperative that the member is at least 18 years old to be able to access our Services, which you must certify, if applicable, when opening the Account.
You must, where applicable, have the authority to bind the company you represent. You certify that you have the authority to bind the company or entity on whose behalf you are accessing our Services, and that the latter unconditionally accepts the T&C.

Account Creation

The Company provides the Services to Members on the Site as set out in Article 4. In order to subscribe to the Services, the Member will follow the procedural steps indicated on the Site. He will fill in all the fields allowing him to identify himself, select the Services and the payment methods. The Member must ensure, before using the Site, that he has the technical and IT resources necessary to use the Site, and that his browser allows secure access to the Site. The Member must also ensure that the computer configuration of his hardware/equipment is in good condition and does not contain viruses.
By using the Website and using the Services, the Member acknowledges and confirms having read, understood and accepted these T&Cs in their entirety without any reservation.
It will be impossible to access our Services for anyone who is not a Member.

Password

Members are responsible for keeping their account passwords confidential and must notify us of any unauthorized account access or security breaches, including the loss or theft of login information.

Description of Services

The Site is an online platform operating by membership and on which, as a Member:
• You can convert multiple document formats to PDF such as Word, Excel, Powerpoint, JPEG and vice versa.
• You can communicate and exchange with PDFZeus by email and chat.
• You can download your documents.
• You benefit from online assistance including all services related to account management, memberships and document conversions. This service translates into the possibility of contacting advisors by telephone, chat or e-mail to obtain information on the Site or the Services.

All of the services listed above are only available to PDFZeus Members, which means subscribing to our membership plan.

Cost

Access to PDFZeus services will be billed at $0.50 for 48 hours, then $49.90 per month. Billing will be done on the anniversary date of the payment or on the last day of the month if this is not possible. Payment for your membership will be made by direct debit and will include the mention PDFZeus or PDFZeus.com.
We reserve the right to change prices at any time with notice to current active users. These changes will not affect the user's current membership period. The prices that were in effect ten (10) days prior to the membership renewal will be applied for payment of the renewed membership period.

Conditions

PDFZeus membership lasts for one month and will be automatically renewed at the end of the current membership period.
You can cancel your PDFZeus membership at any time without any conditions and without charge.

Storage and transfer of information

Information will be stored on secure servers, monitored and maintained in accordance with privacy protection measures. We may store or transfer information about data subjects located in the EU to servers located in countries deemed adequate by the European Commission, or in countries not deemed adequate by the European Commission, provided that those countries implement appropriate and adequate safeguards regarding the security of personal information.
Information is stored on servers only for as long as necessary to provide the services and maintain the integrity of our databases. We will maintain records of processing activities for the purpose of demonstrating compliance with the EU GDPR.
Some services require the use of third-party solutions. When you are redirected from our site to a third-party website, you no longer interact with our site. Any information you provide through third-party websites will be treated in accordance with their privacy policies and other applicable terms.

Premium Member Access

All Services offered by PDFZeus are described as accurately as possible above. We reserve the right to modify the content on the Site at any time without having to notify Members.
The member will find the services to which he has access on the order summary. The member has the possibility to modify the chosen Conversion as well as his information before proceeding to subscribe to our Promotional Offer.
Before validating the subscription to our Promotional Offer, the Member must confirm acceptance of these General Terms and Conditions by checking the validation box provided for this purpose. A clear and legible payment notice appears next to the Order validation icon to ensure that the Member explicitly acknowledges his obligation to pay for the Order.
Following acceptance of the T&Cs by the Member and validation of their subscription to our promotional Offer with payment obligation, the contract will be concluded between the Company and the Member, which will bind them to each other.
The Company will send the Member an order confirmation by email summarizing all the details of their order as well as their identifiers allowing access to their Personal Space.

Price And Payment Conditions Of The Order

It is imperative that the Member pays the monthly membership fee or only the Basic Membership fee, as described on the Site, in order to access the Services offered by PDFZeus. The price of the Simple Offer Member Access is indicated on the Site inclusive of all taxes. They include the amount of VAT applicable on the day of payment.
Membership to the Service is concluded for an indefinite period from the date of subscription, membership is without obligation and cancellable at any time by the Member.
The amount of the membership as well as that of the Basic Membership can be modified at any time by PDFZeus. The Member will be informed in advance 10 days before the end of your current membership, he will thus have the freedom to renew or not his membership.
Member Access and the Simple Offer are payable in advance by direct debit using the payment method indicated on the Site. If PDFZeus finds a failure to pay by the Member, we will make a new payment. In the event of a new failure to pay, PDFZeus reserves the right to terminate the services provided to the Member, without compensation, but without prejudice to its right to claim payment from the Member of the amounts due and any compensation that PDFZeus considers to be due..
PDFZeus uses a service provider specializing in securing online payments to guarantee the security of payments in place on the Site. The credit card transaction carried out between the Member and the secure payment system is encrypted, the Company will never have access to the Member's entire credit card number. This guarantees the Member the total confidentiality of their banking information.
The Member guarantees to the Company that he has the necessary authorizations to use the payment method when placing the Order.

Access To Services And Personal Space

The Company undertakes to ensure that the Member has access to the Services as agreed in these T&Cs. Services. Following the Member's subscription to the Basic Membership, he/she will be provided with the necessary identifiers to allow him/her to access his/her Personal Space. The Member is fully responsible for keeping his/her identifiers confidential in order to keep his/her Personal Space secure. The Member is obliged to immediately inform the Company following any unauthorized use of his/her identifiers. Only the Member will be held liable for any losses or damages resulting from his/her inability to keep his/her identifiers secret.
The Company cannot be held responsible if the inaccessibility of the Services is due to the actions of a third party outside of its responsibility

Support

Following the subscription to a Basic Membership or a Membership, the Member will have the possibility of contacting Online Assistance to obtain information or to make a complaint.

Rules Of Conduct For Members On The Site

The Member undertakes to comply with the terms of these General Terms and Conditions.
The Member undertakes to use the Website and the Services in accordance with the Company's instructions.
For the benefit of all Members, the use of the Site is subject to various rules. Thus, by using this Site, you agree to:
• To use the Website legally, and more generally not to do anything that could be contrary to Applicable Laws and these T&Cs.
• Not to infringe the rights of PDFZeus and its Affiliates, in particular its intellectual property rights.
• Not to attempt to gain unauthorized access to the Website's computer system, not to use any device, software or other elements likely to alter the proper functioning of the Website.
• Not to denigrate the Website and/or the Services as well as the Company on social networks and any other means of communication.
• Not to open an account in the name of anyone other than yourself.
The Company reserves the right to remove a Member's access to the Site and to take all legal and criminal measures against him/her if for any reason the Company considers that the Member does not comply with these General Terms and Conditions.

Membership Cancellation and Refund Policy

In accordance with Article L.221-28 of the Consumer Code, the Member acknowledges that the execution of the Services provided by the Company will be carried out before the end of the legal withdrawal period and therefore expressly waives his legal right of withdrawal.
As part of a membership with a promotional offer and from the validation of the Order, the Member has a period of seven days to contact the Company and request the cancellation of any monthly membership subscription.
If a Member is not satisfied with the services offered by the Company, he/she has the possibility of using the “Satisfied or Refunded” option and requesting the reimbursement of one or more monthly payments of his/her membership by contacting the Company via telephone, chat or e-mail.
Following the cancellation of the monthly membership before the end of the forty-eight-hour Basic Membership or in the event of exercising the “Satisfied or Refunded” option, the Company will reimburse the Member via the same means of payment as that used for the initial Order. If the Member’s reimbursement is impossible due to a change in the Member’s bank details since the date of the initial Order, the Company cannot be held responsible. If such a situation arises, the Member is invited to contact the Company to agree on another reimbursement solution. If the Member is the cause of bank fraud consisting of a false declaration of loss or theft of his bank card following the purchase of a Service on the Site, the Company will not be required to reimburse the Member. In addition, the Member will remain liable for payment of all sums owed to the Company.

Termination Of Membership

The membership subscribed to by the Member is a membership that does not involve any commitment over time, so the Member will simply need to notify the Company by email, chat or telephone of his/her wish to terminate the membership for it to end. The Member also has the option to terminate his/her membership on the Site.
Any termination will take effect from the end of the month of the current membership that remains due. From the effective date of termination, the Member no longer has access to the Member Area or the Services.

Liability

All measures necessary for the proper provision of the service will be put in place by the Company. However, the Company may not be held responsible for the poor performance or non-performance of all or part of the Service if this is due to the Member, to the unforeseeable and insurmountable act of a third party not involved in the Order or to a case of force majeure. If the Company's liability were to be incurred, it could not agree to compensate the Member for direct or indirect damages without proof being established.
Every effort will be made by the Company to allow accessibility to the Site 24 hours a day, 7 days a week. Under no circumstances may the Company be held responsible for unavailability linked to constraints due to the operation of the Internet, maintenance operations, any failure or bug, any event beyond its control or force majeure beyond the reasonable control of the Company.
Links to other sites not edited and controlled by the Company may be present on the Site. Under no circumstances may the Company be held responsible for the operation, content or any element present or obtained through these sites. The presence of these links on the Site should not be interpreted as an express or tacit endorsement by the Company of the content or services provided by these sites. The company cannot be held responsible for the availability of these sites or control their content, advertising, products or any other content.
If the Members' emails were to reject, for example due to anti-spam, emails sent by the Company, and in particular, the copy of the payment receipt or the summary statement of the Order or more broadly any other email coming from the Company, the Company may not be held responsible under any circumstances.

Personal Data

In accordance with the law of 6 January 1978 relating to information technology, files and freedoms, as amended, the Member is informed that the Company collects and processes his/her personal data in order to enable it to process and execute his/her Order(s) placed on the Website.
It is imperative that the Site has access to the following information so that the order process can take place without being blocked: name, first name, email address.
Service providers, particularly hosting providers, established outside the European Union may have access to Members' personal data. The Company has entered into personal data transfer agreements with these providers, including standard contractual clauses approved by the European Commission.
The Member may exercise a right of opposition, rectification, deletion and access to personal data concerning him/her as well as a right of opposition for legitimate reasons exercisable under the conditions provided for by law by sending an email to the Company at the address [email protected] specifying his/her surname, first name, email address and order number.
Information relating to the Member will only be transmitted by the Company to service providers for the purpose of maintenance, hosting of the Site and execution of orders within the limit of the information strictly necessary for the proper execution of the latter.
In accordance with CNIL deliberation no. 2013-378 of December 5, 2013, the Company also informs the Member that cookies record certain information that is stored in the memory of their hard drive. This information is used to generate audience statistics for the Site and to offer Services according to the Services they have already selected during their previous visits. An alert message, in the form of a banner, asks each person visiting the Website, in advance, if the Member wishes to accept cookies. These cookies do not contain confidential information concerning the Members of the Website.
Regardless of the page of the Site to which the Member goes directly from a search engine, he will be informed:
• the specific purposes of the cookies used.
• the possibility to oppose these cookies and to change the settings by clicking on a link present in the banner.
• and the fact that continuing to browse implies consent to the storage of cookies on your device.
The Cookies banner will not disappear until the Member continues browsing, this allows us to guarantee the Member's free and informed consent regarding Cookies.
Unless the Member has given his prior consent, cookies will not be stored or read.
• if the Member goes to the Website (home page or directly to another page of the Site from a search engine for example) and does not continue browsing: a simple lack of action cannot in fact be considered an expression of will.
• or if he clicks on the link in the banner allowing him to configure cookies and, where applicable, refuses the deposit of cookies.

Intellectual Property

This Site is operated by PDFZeus and its affiliates.
Elements such as logos, trademarks, trade names, images, texts, illustrations, audio files, video files as well as the selection, coordination and combination of such elements, are the exclusive property of the Company and are protected by copyright, trademark law, designs and models and/or any other intellectual property rights. All of these rights are reserved for the entire world.
Once you become a Member, you become the beneficiary of a non-exclusive, revocable, personal and non-transferable license to use the Site, for your personal use, or that of the company you represent, and in accordance with the purpose of the Site.
Questions or comments relating to a site outside the Company should be addressed to the operators of these sites; all links to this Site are prohibited without the express prior authorization of the Company.
Any use by the Member of the company names, trademarks and distinct signs belonging to the Company is strictly prohibited except in the event of express prior agreement from the Company.

Applicable Law And Attribution Of Jurisdiction

These T&Cs are governed by and interpreted in accordance with French law, without taking into account the principles of conflicts of laws.
In the event of a dispute that may arise during the interpretation and/or execution of these or in relation to these T&Cs, the Member may decide to submit the dispute with the Company to a conventional mediation procedure or any other alternative dispute resolution method. The Member may in particular contact the courts of Paris, France. The Member acknowledges that before undertaking any mediation process, he/she must first contact the Company by telephone, chat or by e-mail at: [email protected] in order to assert his/her right to a Refund (see 10. Exercising the “Satisfied or Refunded” option).
If this mediation procedure fails or if the Member wishes to refer the matter to a court, the rules of the Code of Civil Procedure will apply.
